How to Claim Per Diem

Option 1 — Employer per diem program: Many trucking companies offer a split between taxable wages and non-taxable per diem reimbursement. For example, instead of $65,000 fully taxable, you might receive $48,000 taxable + $17,000 non-taxable per diem.

In this case: federal taxes calculated on $48,000 only, and FICA on $48,000. The tax savings are even larger.

Option 2 — Employee deduction (Form 2106): Less common since 2018 tax law changes eliminated most miscellaneous itemized deductions. Transportation workers who are not reimbursed can deduct the DOT per diem directly, but must itemize — only beneficial if total itemized deductions exceed $15,000 standard deduction.

Owner-operators run their trucks as a business. The financial picture is very different from company drivers.

Self-Employment Tax

Owner-operators pay both the employer and employee portions of FICA, totaling 15.3% (up to SS wage base) + 2.9% Medicare beyond that.

Owner-operators should pay quarterly estimated taxes (Form 1040-ES) to avoid underpayment penalties. Missing quarterly payments results in penalties even if you pay in full at tax time.

Maximizing Take-Home as a Truck Driver

1. Use employer per diem programs If your carrier offers a per diem split, take it. Even if hourly or CPM rate looks slightly lower, the tax savings often make it worth more in net pay.

2. Log your days away from home meticulously Your logbook is your tax documentation. Keep records of all days away — the per diem can only be claimed for documented days. This is also required by DOT.

3. Consider a Solo 401(k) (owner-operators) Owner-operators can contribute up to $23,500 as employee + up to 25% of net earnings as employer. Maxing this can dramatically reduce taxable income.

4. Track all business expenses (owner-operators) Every dollar of legitimate business expense reduces SE tax by 15.3% in addition to income tax. A $1,000 expense saves $153 in SE tax + $120-$220 in income tax = $273-$373 combined.

5. Home office deduction (owner-operators) If you use a portion of your home exclusively for business (booking loads, accounting), you may qualify for the home office deduction.
